This is really an unusual case: the picture was taken by some terrorist during the kidnapping, as a psychological pressure to force Italian government to give in to blackmail.

According to Italian law, no civil rights can be generated while committing a crime (except for the victims) and the action of taking this picture was completely and solely instrumental for the perpetration of the crime.

Just to look at it from another point of view, should the still unknown author ever claim rights on it (and it has not happened yet, even if this picture is very often reproduced on many media :), the Italian legal system would absolutely refuse to grant any protection to his/her requests, because this would eventually lead to the paradox that the state - I summarise - could be considering protected on one side what it is forbidden on another side.

Therefore, this picture actually has absolutely no rights pending upon because illegally produced. It is then in the public domain because no-one is allowed to claim for eventually related rights. --g 17:48, 21 February 2006 (UTC)

The country of origin of this photograph is Italy. It is in the public domain there because its copyright term has expired. According to Law for the Protection of Copyright and Neighbouring Rights n.633, 22 April 1941 and later revisions, images of people or of aspects, elements and facts of natural or social life, obtained with photographic process or with an analogue one, including reproductions of figurative art and film frames of film stocks (Art. 87) are protected for a period of 20 years from creation (Art. 92). This provision shall not apply to photographs of writings, documents, business papers, material objects, technical drawings and similar products (Art. 87). Italian law makes an important distinction between "works of photographic art" and "simple photographs" (Art. 2, § 7). Photographs that are "intellectual work with creative characteristics" are protected for 70 years after the author's death (Art. 32 bis), whereas simple photographs are protected for a period of 20 years from creation.
